Fee threat for ADIs using tribunal to challenge the Registrar27-08-2015  
The Ministry of Justice (MOJ) is consulting on proposals to introduce fees for proceedings in the first tier tribunal.

This, they say, is so that those who use the tribunal make a contribution to the cost of the service. In turn, this will reduce the cost of the courts and tribunals to the taxpayer.

This could affect how ADIs appeal the Registrar’s decision in relation to:

• their place on the ADI register

• the granting or refusal of trainee licences

• compensation if suspended from the register

If approved this would mean that ADIs seeking to appeal the ADI Registrar’s decision in relation to: their place on the ADI register, the granting or refusal of trainee licences, compensation if suspended from the register would have to pay fees to have their cases heard. Currently hearings at the tribunal are free of charge.

The proposed fees are: £100 to review written statements and an additional £500 to progress to a hearing. The MSA is minded to object to these fees, on the basis that they are excessive amounts for self-employed instructors to have to pay in order to try and maintain their livelihoods.
